Administration - investors, be prepared!

Every day appears to bring a report about yet another major company going into administration, leaving suppliers, investors, landlords and customers uncertain of where they stand.

This year alone well known retailers such as PowerHouse, sandwich shop Benjy’s, fashion retailers Morgan and Kookai, DVD retailer Silver Screen, Allsports, Sock Shop, gift shop chain Past Times and off-licence chain Unwins have all gone into administration.

This comes on the back of the Enterprise Act which promoted administration as the favoured form of insolvency and changed the rules, seeming to shift the balance of power in favour of insolvent tenants.

So where does this leave landlords, managing agents and funders?
