New Code for Leasing Business Premises in England and Wales 2007

On 28 March 2007, the new Code for Leasing Business Premises in England and Wales 2007, produced by the Joint Working Group on Commercial Leases, was launched. Divided into three parts, the Code comprises the Landlord Code, the Occupier Guide and a set of Model Heads of Terms. Although the Code is stated to apply to England and Wales, its authors believe that its principles should apply to the whole of the UK.

The Government have made it clear that legislation will be considered for England and Wales to enforce the issues set out in the Leasing Code if the industry does not take this opportunity to adopt what is being promoted as best practice in relation to commercial leases.

As UK property industry specialists we understand the legal challenges facing your sector and our aim is to update you on relevant issues to help you make your commercial decisions.  This briefing outlines the implications of this Code for Landlords and Tenants.
