A Guide to The Planning etc. (Scotland) Act 2006 - Waste and Extractive Supplement
The Planning etc. (Scotland) Act 2006 received Royal Assent on 20th December, 2006. The Act heralds the most significant change to the planning regime in Scotland for decades which, when brought into force, will have a huge impact on those involved in the delivery of waste projects and those involved in the ‘extractive’ industries in Scotland.
We have produced two guides for industry on the key changes arising from this new legislation. The first presents an overview of the principal changes to the planning system. The second is a supplement for the waste and extractive sectors which highlights those changes which raise particular concerns for operators within these sectors. These include:

The Scottish Government has just produced its first indicative implementation timetable for the Act indicating that it will be consulting on the detail of the reforms. It will be vital for members of the waste and extractive sectors, individually or through their representative bodies, to ensure that the voices of their industries are heard loud and clear. Otherwise there is a real risk that the new system will be no more effective in delivering planning permission for essential projects in these sectors than the current system and a significant opportunity for positive change will have been missed.
