These are ‘interesting times’ for planning in Scotland.
In their seventh annual planning and development seminar, Drivers Jonas and Semple Fraser will look at the two topics currently of greatest concern to developers and planning authorities - the Planning (Scotland) Bill and the future of 'planning gain'.
The Scottish Executive has promised to reform the planning system since 1999. This year, it has finally begun to fulfil that promise.
As the Planning Bill moves towards the statute book, June Gilles of Semple Fraser will consider whether its proposals are genuinely tailored to meet Scotland's needs.
Alastair Wood of Drivers Jonas has been involved in major urban regeneration projects across the UK and will demonstrate what the Bill's changes will really mean for urban development projects in Scotland. Using case studies, he will show the audience how the planning systems in England and Scotland will measure up and seek to establish which system is most 'fit for purpose'?
While planning is devolved to the Executive, taxation is not and so we face Gordon Brown's proposals to impose a levy on developers both north and south of the border to fund the provision of infrastructure. Alix Wotherspoon of Semple Fraser will look at what Gordon Brown’s plans might be, what they might cost and how they might interact with planning agreements and obligations.
Finally, despite the current uncertainties, developers and planning authorities still need to plan ahead. Maria Francké of Drivers Jonas will offer strategic advice and practical solutions to deal with planning and undertaking development over the next two or three years, while the new system crystallizes.
