Waste

Semple Fraser is immersed in the waste industry and the world of industrial regulation. We have carved a deserved niche for industry-leading advice in the massively complex area of EU and UK waste law.  As the industry has developed, so we have developed with it.

When the European Commission sought to evaluate the developing waste and industrial emissions laws of a range of new Member States, Semple Fraser delivered the multi-jurisdictional evaluation.

When the crunch came between UK law and EU law on the definition of waste, and when the UK’s leading waste oils recycler sought to contest the UK Government’s legal position, it was Semple Fraser who initiated the legal case and went on to lead the legal team to victory in the Court of Appeal in London, overturning a decade of UK law and regulatory practice, including two hitherto “untouchable” rulings of the High Court in London.

Our expertise derives from our having thus driven cutting edge development of the fundamental legal and regulatory side of waste and resources development and commercial exploitation. In short, we have promoted the turning of the regulatory tide back in favour of industry. As lawyers for industry, and with the bedrock of our knowledge and experience in EU waste law, we naturally also have years of experience and market leading expertise in all areas of UK waste and industrial regulation.

Our waste lawyers are true specialists and acknowledged leaders in their field. This means knowing the law inside out and knowing what is coming down the line from Brussels.  As such, our daily practice includes all the tough areas of regulation and liability, where only truly specialist legal advice will suffice. For example: PPC permitting, exemptions, appeals and technical negotiations with the regulators (including specialist advice on the application of BAT); specific advice related to landfill, incineration, recycling, and other forms of disposal and recovery; the entire legal regime driving “Energy from Waste”; the impact of “REACH” on industrial materials recovery substances; producer responsibility; “start to finish” regulatory risk management and contractual liability allocation in contaminated land and brownfield construction and development; bespoke, specialist commercial contracting – making sure your industrial business contracts deliver your commercial goals and keep you free of liability.

Most important of all, we pride ourselves in being in tune with the industry as it develops. The agenda is shifting from liability to commercial opportunity, via the transformation of waste into resource, liability into profit. In this changing scene, "waste" and "energy" have become inextricably linked. Renewable Energy and Waste to Energy are the new frontiers of commercial exploitation for the “waste” industry, and for the wider industrial community.

It is equally logical that Semple Fraser should be making that journey with industry. To that end, our distinctive offerings in Waste and Renewable Energy are at the same time deeply collaborative and cross-fertilised by mutually supporting specialist expertise.
