The legal and regulatory position in the UK on waste, industrial by-products and secondary raw materials has never been more chaotic.
Investment in affected sectors is fraught with risk and lack of clarity. Liability seems to stalk commercial ambition.
In what circumstances are the by-products and secondary raw materials in your industrial sector excluded from waste regulation? Are they excluded at all? Are there technical adjustments you can make to ensure they are excluded?
These are critical business issues and the stakes can be very high.
Classification of your by-products and secondary raw materials as waste has all kinds of cost and liability implications – this is especially so just now if you, or your customers or suppliers are on the “radar” of the Waste Incineration Directive, although that’s just one obvious, if extremely problematic, area.
When materials legally leave the waste stream is arguably the most contentious issue of all. Sadly it is rare to get any clarity on when residues, by-products and other “products” of industrial operations are either not waste or cease to be waste. There are some very dogmatic and anti-industry interpretations of EU Law on this issue.
This Semple Fraser conference aims to provide industry with clarity and greater certainty in this area, and better inform investment and technical decision making.
Of course, help seems to be on the way. Our clients, the European Commission, are aware of the problems facing industry. There is a new Waste Directive due next year which will help, to a degree. However, do not expect wholesale changes. The current legal framework will remain. You need to understand how the law works just now, albeit in the context of the changes being made in Brussels.
Industrial waste classification problems may not be solved in one day, but the first milestone has to be industry clarity of understanding of what the law is, and how this is likely to develop in the next few years.
