Kenneth Carruthers

Partner

Kenneth Carruthers leads the firm’s Litigation Group and is acknowledged as a leading individual in the fields of planning law and commercial litigation, where peers consider him “a really strong practitioner.”

Kenneth began professional life as a planner and retains membership of the Royal Town Planning Institute.  He qualified as a solicitor in 1991 and became a Partner of Semple Fraser in November 1999.  His focus with the firm has been in development related dispute resolution including planning, compulsory purchase and general property litigation, acting for clients such as British Land, JJ Gallagher, BAE Systems, Standard Life, Clydeport and Tesco.  He also maintains a more general commercial litigation case load and has a particular interest in professional indemnity claims concerning in particular surveyors, engineers, architects and other professionals.

Kenneth appears regularly at planning and other inquiries.  He frequently conducts litigation in the Court of Session, the Lands Tribunal and has twice been to the House of Lords.  He is routinely involved in running and defending applications for judicial review, statutory appeals under the planning legislation and regularly litigates in the Commercial Court.  Clients greatly value his pragmatism, the strategic advice he provides and his ability to secure sound commercial resolutions where litigation through the courts is to be avoided.  Kenneth has also undertaken mediation training.
