Stuart Macfarlane has been with Semple Fraser since 1992 and was the founder Head of the Construction Group.  He has extensive experience in both contentious and non-contentious work and has notable successes in conducting arbitrations against Senior Counsel. 

He has a particular interest in building contract arbitrations and adjudications and has an eye to resolve disputes in a commercially sensible way.  Recommended as a leader in his field by the legal directories, he is described as “approachable, knowledgeable and pragmatic”, and continues to draw plaudits from the market.

Stuart conducted one of the first commercial ADRs (Alternative Dispute Resolutions) in Scotland.  He is a member of the Adjudication Society and is regularly invited by RICS to adjudication discussions as part of their Dispute Resolution Faculty.  Stuart also advises, arbiters and adjudicates on legal and procedural issues and assisted RICS in drawing up their guidelines for surveyors acting as arbiters. 

Stuart represented Sir Robert McAlpine Ltd v the Scottish Parliamentary Corporate Body regarding the high profile procurement process for the new Scottish Parliament building, and also advises the firm’s key clients such as Royal & Sun Alliance, Six Continents, Kier Construction, Briggs Amasco and Ashleigh Construction.
